Kabana AI™ Privacy Policy

Kabana AI™ is provided by IndustryConnect, d/b/a Kabana AI, a New Jersey corporation with a business mailing address at 70 South Orange Avenue Suite 105 Livingston, NY 07039 (“Kabana AI” or “we” or the “Company” or the "Companies"), and your use as described herein & throughout this Agreement shall constitute your unconditional and irrevocable agreement with each and every clause within these Terms of Use, Privacy Policy, and other agreements contained on this page, regardless of whether your usage is paid or a part of a free trial.

By using the Platform/Platform(s), you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Please read this Privacy Policy carefully, and contact us if you have any questions.

  • Provide, maintain, troubleshoot, and improve the Platform

  • Personalize your experience on the Platform

  • Analyze usage trends and patterns to improve the Platform and develop new products and services

How We Share Your Information

We may share your Personal Information in the following circumstances:

1. Service Providers

We may share your Personal Information with Service Providers that perform services on our behalf or help us provide the Platform to you. These Service Providers are bound by contractual obligations to keep your Personal Information confidential and use it only for the purposes for which we disclose it to them.

2. Advertising Partners

We may allow certain third-party advertising partners to collect information about your use of the Platform and other online properties over time so that they may play or display ads on the Platform, on other websites, apps, or services you may use, and on other devices you may use. 3. Analytics Providers

We may share your Personal Information with analytics providers that perform analytics services on our behalf to help us understand how the Platform is being used and how to improve it.

4. Corporate Transactions

We may share your Personal Information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

4.1 Data Collection and Predictive Analytics

Kabana AI collects data from its users to improve its sales and marketing automation features. Kabana AI may parse through millions of data points to utilize predictive analytics principles to build its automation engine(s). This data may include, but is not limited to, user behavior on the Kabana AI platform.

4.2 Third-Party Advertisers

Kabana AI may profit from allowing third-party advertisers to choose filters for accessing users via the Kabana AI platform to display ads. Kabana AI does not provide any personal information to third-party advertisers, and all advertisements are subject to our advertising policies.

4.3 Use of Commercially Available Algorithms

Kabana AI uses OpenAI, Anthropic, or other blends of proprietary and commercialized algorithms to enhance the user experience and provide insights to the Kabana AI team about how to improve the product and/or value of the company. This may include analyzing user data to identify patterns and trends, improving our automation engine, and creating new features and services.

4.4 Repurposing of Data

Kabana AI may repurpose the data collected from users for sale to third-party companies. This data will be anonymized and aggregated, and will not include any personally identifying information. We may use the insights gained from the OpenAI algorithms to improve the quality of the data and make it more valuable to third-party companies.

4.5 Super Database

Kabana AI is building its own LLMs and thus is building a super database, or a data lake, of buyer intent patterns augmented by contact information. This database will be used to improve the quality of the data and make it more valuable to third-party companies. Even if you are not a user of a Kabana AI product, your information may be collected and remain in this database. By using our platform, you acknowledge and consent to the creation and maintenance of this super database.

5. Legal Requirements

We may share your Personal Information if required to do so by law or on the good-faith belief that such action is necessary to:

  • Comply with a legal obligation

  • Protect or defend our rights, interests, or property, or those of third parties

  • Investigate, prevent, or take action regarding illegal activities, suspected fraud, threats to safety, or violations of our terms and policies

  • Respond to valid requests by public authorities, including to meet national security or law enforcement requirements

6. Consent

We may share your Personal Information with your consent, such as when you agree to share your information with third parties for their own marketing purposes as allowed by law.

We retain your Personal Information for as long as needed for the purposes for which it was collected and as set out in this Privacy Policy, subject to legal obligations or other business requirements, including to:

  • Complete the transaction or service for which the Personal Information was collected

  • Provide the Platform to you

You have the right to access, update, and correct your Personal Information. You may also request that we delete your Personal Information. However, we may need to retain certain information for recordkeeping purposes or to complete transactions that you have initiated prior to requesting such deletion.

If you opt-out, we may still send you non-promotional emails, such as those related to your account or transactions with us. Depending on your location and subject to applicable law, these may include:

  • Right to Know: You may request disclosure of the specific pieces and/or categories of Personal Information we have collected about you within the past 12 months, the categories of sources for that Personal Information, and the business or commercial purposes for collecting that Personal Information.

  • Right to Delete: You may request that we delete the Personal Information that we have collected about you, subject to certain exceptions.
